Can you please help me with this credit card problem?
credit card #AB CD was stolen from me. I did report it to the company and they issued me a new card #AB EF. I did call to activate it, but I never used ABEF. The stolen card ABCD made last payments in 2002. So now I am being sued by Resurgence for ABEF. Neither card was ever reported to the credit bureau. The SOL is 5 years in Illinois. I actually forgot ABCD debt which was stolen. Resurgence is now suing me on ABEF and did it 4 days before the SOL was up and has no transaction history on it. Their evidence showed no title of assignee and the contract agreement copyright date was 5 years older then when they said I opened the account When you sign an agreement it is copyrighted the year you signed it. Companies don’t post date copyright years for contracts. If you signed in 1998 the copyright says 1998 not 2003. The court asked them to do a discovery because they showed nothing. How can I save myself by not being sued on ABCD, because they filed notices for me to produce documents that I don’t have and interrogatories that require names of banking institutions I’ve used over the last ten years. Because they didn’t have any evidence they are doing a freeby in getting me to do the discovery. I don’t believe they have anything. I requested them to send me debt validation. They sent me a copy of 1 billing statement on ABEF with no transaction history. So can anybody help me with some advice? I cannot afford an attorney and trying to do the right things. Since the stolen ABCD’s SOL has passed. Can they sue me on that one? Who can I write to show I cannot be sued on ABCD? God help!
If the SOL on debt In your state is five years and it has passed than they can no longer legally come after you for the debt. Of course they don't want you to know that! Even if they are dumb enough to try and sue you forbit they WILL lose.
The validation they gave you isn't good enough.
